Terms & Conditions of joining ExcelHotels.com

  1. In this agreement, the following expressions, in the correct context, shall have the following meanings: Customer(s) - any person who makes a reservation for a accommodation via excelhotels.com or any other site owned by Excel Hotels Limited. Hotel - the establishment and its employees. EH - Excel Hotels Ltd.
  2. The Hotel agrees to appoint EH as its agent to encourage the sale of Hotel services to customers. EH agrees to act in that capacity, subject to the terms and conditions of this agreement.
  3. The rights to the excelhotels.com website and all content, including Customer details, data, EH logo and site design remain the property and copyright of EH. The accuracy of published content will be based on the information the Hotel provides. Images and logos are provided by the Hotel and remain the property and copyright of the Hotel. EH will not be held responsible or liable for incorrect information or errors which are loaded by the Hotel
  4. The Hotel confirms that the information provided in the EH extranet will be correct and updated as and when required. EH reserves the right to temporarily suspend the Hotel should it be found to be misusing the extranet or if EH notice an error that would be visible to Hotel Customers. The Hotel will be reactivated as soon as the error is corrected.
  5. The Hotel agrees to provide EH with non-exclusive right and licence to publish and advertise the Hotel name, logo, images for all purposes connected with the sale of rooms.
  6. The Hotel shall:
    1. ensure rates quoted on excelhotels.com are the best available rates online and rate parity is maintained at all times
    2. ensure room type availability is correct and updated regularly on the understanding that live availability published on Excelhotels.com operates on a rolling 12 month period
    3. Promptly address any Customer matters arising including complaints and enquiries
    4. Comply with all applicable laws and regulations relating to the sale of rooms without limitation
    5. Maintain confidentiality when handling Customer reservations, ensure credit card details are stored securely and only use this Customer information for the purpose of confirming the reservation
    6. Not, send any correspondence to the Customer, which is not in connection to the reservation
    7. Not, knowingly harm or cause a derogation relating to the EH brand and identity including any illegal act
    8. Clearly state its cancellation policy using the hotelier’s extranet
    9. ensure that all accounting administration relating to excelhotels.com is accurate
  7. EH will refer all Customer complaints directly to the Hotel. The Hotel agrees to respond to and resolve any complaints within 48 hours of receipt. EH accepts no responsibility, nor any liability relating to complaints from any Customer.
  8. Neither party shall be liable to the other for any indirect or consequential loss including damage, economical loss, profit loss, contract loss, business loss or any costs, expenses or claims for compensation whatsoever which arise in connection with this agreement. Nothing in this agreement excludes or limits the liability of either party for death or personal injury caused by that party's negligence or fraudulent misrepresentation. The contract for the purchase of the Product is between the Customer and the Hotel. EH has no contractual liability to the Customer in respect of the product the Customer purchases.
  9. The Hotel shall honour all reservations made by EH Customers. In the event of a room not being available, the Hotel agrees to find alternative accommodation, which is of a comparable, or higher standard and which is to the Customer's satisfaction. If required, the Hotel must provide transport to the alternative establishment. EH will not be held responsible for any extra costs, which are incurred, to the Hotel or the Customer in this instance.
  10. The standard room rate commission charged by EH for online Hotel reservations is 10% of the gross room rate. EH debits 10% of the total booking from the Customer at the time of making the reservation as a deposit. This 10% will be retained by EH as booking commission. Business to business financial transactions are strictly confidential therefore the Hotel agrees not to disclose to the Customer that the 10% deposit they have paid in advance is retained by EH as commission. By charging commission at source both parties save the high accounting and administration costs associated with processing commission invoices and payment. Furthermore, customers who have paid a deposit are less likely to cancel.

    EXAMPLE - The customer is charged as follows:
    Customer books two nights accommodation at NZ $50.00 per night

    Total gross room rate booked:
    NZ $100.00
    Deposit at 10% of total:
    NZ $10.00
    Amount paid at the time of booking:
    NZ $12.50
    Amount to pay at the hotel:
    NZ $90.00

    Confirmed reservations are instantly delivered to the Hotel by email and fax. Customer credit or debit card details are provided in the ‘view reservations’ area of the hoteliers extranet. The Hotel is responsible for ensuring the Customer pays the remaining 90% of the room rate they booked plus any extras on their account prior to departure from the Hotel. EH is not responsible for any Customers who do not settle their account for any reason. If, for any reason, the hotel charges the Customer the incorrect room rate the Hotel must process the refund immediately. In this situation the Hotel will be in breach of this agreement and the Hotel may be temporarily suspended from excelhotels.com and all associated sites until EH has been informed that the Customer has been reimbursed. Both parties shall keep accounts and reservation records for no less than one year.

  11. If a Customer wishes to cancel their reservation they must do so directly with the Hotel. EH clearly states on the Customer’s booking confirmation that they must contact the Hotel directly by email should they need to cancel. EH will not process cancellations. When a customer cancels the Hotel must alter the reservation status in the EH hoteliers extranet from ‘booked’ to ‘cancelled’. Any no shows and/or reservations not cancelled in line with the Hotels cancellation policy remain commissionable.
  12. EH accepts no liability for any loss of potential revenue in the event of internet or ISP failure.
  13. The Hotel agrees to keep extranet user names and passwords confidential. The Hotel will only disclose this information to the designated personnel within the establishment. Due to the confidential Customer information the EH extranet holds, user names and passwords must be changed should an employee, who has previously had access to the extranet, leave the employment of the Hotel. EH will accept changes to your user name and password from the person listed as the main contact or the Hotel General Manager. All changes must be requested by email.
  14. This agreement will be activated from the date on the initial agreement. One month’s notice in writing by either party is required to terminate the agreement.
  15. By agreeing to feature on www.excelhotels.com the Hotel agrees to the above terms and conditions of working with EH
